By accessing or using the AMIGO BUDDY service (the "Service"), operated by AMIGO BUDDY ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Service Description

AMIGO BUDDY is an AI-powered conversational assistant available via Telegram bot (@amigo_buddy_bot) and web interface. The Service provides:

• AI-powered conversation assistance using GPT-5 Nano technology
• Emotional intelligence support for better communication
• Multi-language support (Portuguese and English)
• Various subscription tiers with different message limits

3. Account Registration

To use certain features of the Service, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Subscription Plans and Billing

All paid subscriptions are billed monthly in advance through Stripe, our payment processor. By subscribing, you authorize us to charge your selected payment method on a recurring basis. You may cancel your subscription at any time through your account settings or by contacting support.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Distribute spam or malicious content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for any illegal or unauthorized purpose

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by AMIGO BUDDY and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of content you submit but grant us a license to use it in connection with providing the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMIGO BUDDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless AMIGO BUDDY and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising from your use of the Service or violation of these Terms.

11. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AMIGO BUDDY operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
